Non compliance of the Information called for under RTA Act.
There is a dispute between the partner and share holders of the M/s Nabi touring Talkies, Kodumur village and Mandal of Kurnool district. The legal heirs of one of the partner cum share holder have given a letter to the Revenue Divisional Officer Mr. Balaiah of Kurnool district on 8.12.2010 for not to renew the B- form licence and stop screening of films as the legal heirs of other partner are running the cinimas without giving the due share of profits. On 10.01.2011 they have given one more letter to the RDO of Kurnool calling for 11 points information under RTA Act and requested him to give xerox copies of the supported documents duly authenticated by him along with the reply. The RDO has not responded the information called for under RTA Act till 15.4.2011. Again the complainants lawyer has sent the notice to the RDO on 22.01.2011 for not to renew the licence of the said Nabi Touring Talkies. The RDO is expected to reply the information called for under RTA Act within 30 days, but the RDO of Kurnool has took three months ten days to reply the letter dated 10.01.2011 and has given incomplete reply vide his letter dated 16.04.2011 answering six points only, out of 11 the points called without submitting the xerox copies of the relevant documents called for under the RTA Act. The cinema licence was not renewed for one year and it was running unauthorisedly without the licence as per the statement appeared in Surya Newspaper on 15.10.2011 when the Nabi touring talkies inspection was condcuted by Mr. Balaiah, RDO of kurnool, Mr. Siva Sankar Naik Tehsildar of Kodumur, Mr. Obulesu, Tehsildar of Gudur and Village Revenue Officers namely Krishna Murthy, Yellappa, Narayana etc.based on the complaints of the local public. Meanwhile we the complainanta have given a letter to the District collector on 18.4.2011 explaining and enclosing the details of our correspondence and sought his interference in stopping of the renewal of the licence. After receiving the above letters from our lawyer and letter from the district collector, the RDO of Kurnool Mr. Balaiah has renewed the licence of the Nabi touring talkies back dated on 20.01.2011 just two days prior to the lalwyar notice dated 22.01.2011and he has replied to our letter dated 10.01.2011 on 16.04.2011 just two days prior to our letter 18.4.2011 addressed to the district collector. This clearly shows that the RDO of Kurnool has done undue favour to one party with vested interest, inspite of our plea not to do so. Further he has not given the relevant papers called for and not replied to all the information called for under RTA Act. Hence we request for the reply for the above points in details.
