refund our payment with interest at the time

i am narinder dua
i have booked a duplex in tdi dated 24.12.2011 and my booking no. ktf-300119 . i have not been given allotment of the property in tdi tuscan city ,kundli as committed your company . therefore requested to refund my total payment 11,53,970/ with interest since i do not intend to purchase this property now.
please give me refund as earliest possible . my jago grahak jago consumer court complaint number is 514780 dated 29/05/2014.

DELAYING POSSESION

Subject: Regarding your letter dated 06.07.2011, received by the undersigned.

Sir,

I am the allottee of the flat no. G9-0802, in tower no. G9, [ Customer ID: KFL-10315] which was allotted to me as back as on dated 13.03.2007, and regarding which the agreement was also duly executed by your company in my favour on dated 16.04.2007. Further, against this Flat even the following payments also stand received by your company:-

1. Rs. 3,00,000/- as Advance Payment.
2. Rs. 6,19,674/- against installments no. 2, 3 & 4 on 19.02.2007, and also,
3. Rs. 2,92,152/- on 27.09.2010, which was demanded by your company as EDC charges, vide your letter dated 07.09.2010, and in this letter it was also alleged that the development on the site is in full swing.

However, now TDI office has issued me a letter dated 06.07.2011, wherein it is alleged that the construction of this Tower has been delayed due to unavoidable circumstances (though no details/ reasons mentioned) and as such your company may accommodate my allotment in your existing S/ W Tower, which is alleged to be at an advance stage. Further, in this letter it is also alleged that this is a limited period offer and as such I should come and collect my allotment letter on or before 25.07.2011, failing which the provisional allotment will be suspended and extended to some other customer.

However, I am shocked to receive this letter from your office, especially when the same follows just after the few months of your earlier letter dated 07.09.2010, whereby an amount of Rs. 2,92,152/- was demanded as EDC charges by company, by alleging that the construction of the Tower and site is in full swing.

Further, your letter is also completely silent as to the terms and conditions on which the allotment will be accommodated by your company in the existing S/W Tower ; and nor even the tentative period for completion of construction and offer of possession has been chosen to be mentioned in this letter.

It would not be out of place to mention over here that though according to the terms of the agreement dated 16.04.2007, TDI company had specifically assured to complete the construction and deliver the possession within a period of 2 years from the date of execution of this agreement. Further, though as per the schedule of payment, the payments and also of the EDC were to be paid on start of Ground Floor Roof Slab. But still your company not only failed to start construction on site, though a period of more than 5 years has already elapsed; but further your company also demanded and received a heavy amount towards EDC charges for this flat, by falsely representing that the construction of this Tower is in full swing. And now, after having received the alleged EDC charges for the allotted plot, the present letter has also been issued by your office for accommodation of this allotment in a different tower; that also, without even disclosing therein the terms and conditions for this new/ alternate allotment.

Apart from it, when I also personally visited TDI office in connection with this letter dated 06.07.2011, none of the employees or representatives of your company was ready to disclose the present stage of construction even at this existing S/W Tower site or the tentative period during which the possession of the alternate Flat can be actually delivered by company. Further, no satisfactory response was also given as regards the amounts, especially the EDC charges already taken by your company for the earlier allotted plot. Besides, even the rate and the area of the superstructure of the Flat, now sought to be offered in the S/W Tower has also not been disclosed by your company till date. Though it has been orally told to me by your employees, that for this alternate plot offered in the existing S/W Tower, the rate charged by your company would be the present market rate and not the rate which was settled under the agreement dated 16.04.2007.

It is submitted that I am a middle class person and have already deposited a sum of more than Rs.12 lacs with your company for this Flat G9 – 0802 and have already waited for a period of more than six years. But whereas, till date there is no clarification and nor even any assurance as to whether your company is ever going to deliver the possession of any Plot. Whereas, on the other hand the price escalation in this five years period, has also now badly affected me without my fault.

Hence, by way of this letter the undersigned prays that the afore mentioned information/ clarifications be supplied to the undersigned at the earliest and further, in case your company is not in a position to deliver the possession of the allotted Flat within a fixed span of time, the undersigned be returned double the amount already received by your company along with Interest, so that I may look out for other options.

Treat it as most urgent.

Dear Respected sir I hereby trouble to inform that TDI has refused me to issuance of NOC for getting possession of my flat G3 -103
KFL13642-Rashmi Chauhan As per your knowledge payment had already done by 11/06/2012.Look the matter On date 11/06/2012 I meet from mr Saurabh for clear the balance dues, He told that kindly pay your balance 27, 475 + 1, 00000, one lac INR(open parking charges)then after clearence we will issue you NOC letter for possession of your flat, When I visited today your TDI office both mr.Anthony malik and mr. Saurabh refused me for issuance of NOC for getting possession, Told that kindly pay extra parking charges we have not available open parking, But on 11/06/2012 mr saurabh had alot and got INR 1, 00000 as open parking charges.Now at this stage I have suffered physically mantally and financial crises that I am homeless person even I have paid all payment to TDI.

Hello,

I would like to advise you that you have to send a legal notice through an Advocate & then file a consumer complaint case against TDI under the provisions of Consumer Protection Act, 1986 in the District Consumer Redressal Forum in order to receive back refund of your initial booking/registration amount along with interest and comepensation from such Builders. I have handling some cases against TDI.

I am looking forward to hear a prompt reply from our end.

They are going to make us feel like hell, believe me. But we won't do anything. I know there is a TDI Kawa association built to fight. But most of cone head members think its the association that has to fight, they just have to hide their faces so that TDI dont see them. And these spineless worms lurking around will let their children one day their are so mightiest and best in the world...these spineless people have made our lives so messy in this country and we will leave it messier for our children...

TDI is taking undue advantage of our patience and unnecessarily delaying the possession of plots for faults which they have committed while depositing EDC's with Haryana Govt.

I have statements stating no dues pending but when the EDC was enhanced they charged us the interest on it as well which was not mentioned in previous statements..

The govt. has to take action against such builder monopoly and address issues to the harassed public at large. And cancell there further project.
