membership number 106233 case for cheating and fraud

My membership number is 106233. When i signed up in 2015, i signed up for a 3 month period since i had to go abroad.

I was charged Rs 7200 per month. there was no approval given from my side and you can check from your records that from APRIL 2016 TILL FEB OR MARCH OF 2017, i did not go to the gym even a single time.

I had gone for an international assignment to The netherlands, not knowing that you are charging my card automatically. It was only when i cancelled my credit card subscription, i received a collection call from fitness first that I realised that you have charged me a total of Rs 79,200/- without me providing any consent and NOT HAVING GONE TO THE GYM EVEN A SINGLE DAY.

In the month of March and April 2017, i rejoined the Gym and the following are my demands.

- Immediate refund of Rs 79,200 + applicable saving banks interest to be given to me on account of this fraudulent withdrawl.
- Immediate stoppage of SMS of pending Gym amount of Rs 14600, i dont owe you anything, you owe me money for fraudulently charging me a frivolous amount.

Also, on what basis have you charged me 7200 for the entire year without my consent.
I need a response in the next 48 hours before i will lodge a cheating FIR against you and send you legal notice for harassment and fraudulent withdrawl of money from my credit card for 10 months.

Cheating and harassment the customer

This is to bring to your notice that I have been cheated by a fitness company i.e. Fitness First India Pvt Ltd(GURGAON Branch) which actually made so many false promises at the time of closing the sale but did not deliver at all and ended up in the most pathetic and worst service one can expect from an MNC chain. I became the member of the above mentioned Gym as I had gone there once for enquiring about their services, and after that their sales executives were after my life to join the club and offered me good amount of lucrative benefits and attractive discounts. Somehow as it was close to my office I made up my mind and was ready to sign up and the deal was closed by one of their sales executive who acted very sweet and humble at that point of time and took my registration.

I have been duped and harassed fully by this fitness chain which is allowing me to end my relationship with them and was only interested in taking the memberships and collecting the money of different members.the same thing has been experienced by my other colleague also.
Pls tell me what to do and want to teach them a lesson for totally misguiding customers and doing these kind of harassment and fraud. These kind of organizations are crooks and are only here for short term gains and actually can't manage the things properly. Looking forward for the desired support with a due sense of urgency
